Dear Mr Chin
Legal Practice Board: Restriction on Independent Legal Practice
Thank you for your email dated 21 October 2009, outlining your concerns about the conduct of the Legal Practice Board of Western Australia and their decision to place restrictions on your Practice Certificate, thereby restricting your ability to practice as an independent barrister and solicitor.
Please be assured that my staff have provided me with a detailed examination of the issues you have raised. I have also been made aware that your opportunities for review have been utilised – with the decision of the Legal Practice Board being upheld by the State Administrative Tribunal in October 2008, and the Supreme Court (Court of Appeal) refusing to grant leave to appeal in June 2009. As such, two separate bodies have provided an independent review of original decision made by the Legal Practice Board, and effectively upheld the conditions placed on your Practice Certificate.
I have forwarded your concerns to the office of the Attorney-General, who is best placed to deal with any further concerns you may wish to raise. Thank you for taking the time to contact my office.

The Honourable Helen Morton MLC: My comments are as follows:
1) Justice Chaney decision in VR107 of 2008 is flawed on the following grounds:
a) He thinks I have a proclivity to make false allegations against fellow lawyers. This is not true as regards Mr. Timothy Robin Thies and Mr. David Taylor which is currently being litigated in CIV1903 of 2008, CIV1112 of 2007 and CIV1981 of 2010.
b) I did not make any false allegations against Mr. David Taylor and the matter has been through the High Court in P1 of 2010. The High Court suggested that I need to prove the causal connection between my solicitors work and the removal of the Spunter's Caveats. This issue is being taken up in CIV 1877 of 2010. There is that causal connection if there were no such falsifications of court records in CIV1131 of 2006.
c) The only issue that was refused to be litigated by the trial judge Justice Chaney concerns the presence of the Pseudo Board which usurp the lawful authority of the regulator of the legal profession in WA. The Pseudo admitted its existence at least three times by its inability to produce its minutes evidencing that it is making the null decision to unreasonably curb the independent law practice of the practitioner without the majority consent of the 52 members of the Legal Practice Board of WA. This contravenes the regulations and the statutory provisions governing the functions of that regulator. This issue will never go away as long as it is not being recognised by the courts and litigated.
c) The learned Justice Chaney is also involved in re-persecuting me for the common law debarred FURTHER REMEDY of some contrived professional misconduct.

If I am not allowed to express my desire to make Australia a truly democratic nation to uphold a public interests, there is no more that I can for this nation I cherish in fulfillment of its multi-cultural interests, then I should just retire and leave this thankless tasks for others to pursue. I just resigned to my fate that the Lord does not permit to pursue it further.... Lord help me to fulfill my desire....
